1) Scope & definitions

These Terms & Conditions (“Terms”) govern air transportation provided by Elite Airline Company K.S.C. (Public) (“Elite Air”, “we”, “us”, “our”). They apply to tickets purchased directly or via authorized agents, and to travel on flights operated by Elite Air. If your itinerary includes other airlines, their terms may also apply.

2) Contract of carriage

Your contract of carriage consists of (i) the ticket/PNR, (ii) these Terms, (iii) applicable fare rules, and (iv) our policies referenced herein. By completing a purchase, you accept the contract of carriage.

Note: If a route involves a partner airline or a refuelling stop, that partner’s terms or local regulations may also apply.

3) Booking & tickets

  • Provide accurate guest details and ensure names match travel documents.
  • Tickets are valid only for the named passenger and may not be transferred.
  • Fare rules determine change/refund options; charges may apply.
  • We may cancel unpaid, fraudulent, or fare‑rule‑violating bookings.

4) Fares, taxes & fees

Fares generally exclude government taxes, airport charges, and service fees unless expressly stated. The final price is displayed before payment. Your issuer may apply currency/FX charges.

5) Schedules, changes & cancellations

Flight times are planned carefully but not guaranteed. We may adjust schedules for operational, safety, or regulatory reasons. If we cancel or significantly change a flight, we will offer re‑accommodation or a refund in line with law and fare rules.

6) Check‑in & boarding

  • Arrive with sufficient time to complete formalities; deadlines vary by airport.
  • Boarding may be denied if deadlines or documentation are not met.
  • Seat assignments may change for safety/operational reasons.

7) Baggage rules

  • Carry‑on/checked allowances depend on fare and route.
  • Prohibited/dangerous items are not permitted; declare restricted items.
  • For loss or damage, report immediately upon arrival and in writing within legal time limits.

8) Special assistance

If you require mobility or medical assistance, please notify us during booking or at least 48 hours prior to departure so we can prepare. Some medical devices/oxygen require documentation.

9) Refusal of carriage

We may refuse carriage or remove a guest for reasons including safety, security, invalid travel documents, disruptive behavior, intoxication, non‑payment, or non‑compliance with crew instructions, or if carriage would contravene law.

10) Conduct on board

Guests must follow crew instructions at all times. Smoking (including e‑cigarettes) is prohibited. Tampering with smoke detectors is a criminal offense. We may take reasonable measures, including restraint, where necessary to ensure safety.

11) Liability

Our liability is governed by applicable conventions and laws (including the Montreal Convention, where applicable) and may be limited or excluded. We are not liable for indirect or consequential loss except as required by law. For baggage claims, statutory limits and timeframes apply.

12) Refunds

Refund eligibility depends on the fare rules and applicable regulations. Refunds are made to the original form of payment or as a travel credit where permitted. Service fees may be non‑refundable unless required by law.

13) Travel documents

You are responsible for obtaining valid passports, visas, health documents, and any other entry requirements. We are not responsible for losses due to failure to comply with governmental requirements.

14) Data protection

We process personal data in accordance with our Privacy Policy. Border agencies may require sharing Advance Passenger Information (API/PNR). By traveling with us, you consent to such processing as permitted by law.

15) Governing law & venue

Unless mandatory law states otherwise, these Terms are governed by the laws of the State of Kuwait. Courts in Kuwait have exclusive jurisdiction over disputes arising out of or in connection with these Terms and your contract of carriage.
