Membership, elevated — choose your tier

1) Parties & Formation

Agreement between Elite Airline Company K.S.C. (Public) (“Elite Air”) and the individual purchaser (“Member”). Membership starts on the activation date stated on your receipt/welcome notice.

2) Tiers, Fees & Term

1. Tier 1 — 10,000 KWD per year; advance booking from 3 days prior departure.
2. Tier 2 — 5,000 KWD per year; advance booking from 6 days prior departure.
3. Term is 12 months from activation. Fees are non-refundable once activated.

3) Core Benefits

1. Daily access: book one seat per calendar day on any scheduled Elite Air flight (subject to availability and your tier’s advance window).
2. Giftability: you may assign a booking to another traveler provided it respects the tier’s minimum advance notice and all travel requirements.
3. Ground services: where available and shown on your fare, priority check-in, fast-track security, and Meet & Assist are included or available as add-ons.

4) Booking Rules & “Booking Lock”

1. Advance notice: Tier 1 requires ≥ 3 days; Tier 2 requires ≥ 6 days prior to departure for guaranteed member access. Inside the window, travel is subject to load and current fare rules.
2. Booking lock: when a booking is active (“hanging”), you may not create another member booking until the first sector is flown unless both sectors are booked in the Member’s own name. If any sector is in a guest’s name, no additional member booking can be made until the first sector is completed.
3. Channels: website, app, or member services. Your membership ID must be supplied to access benefits.

5) Family & Friends Arrangements

1. For travel with first-degree family (or nominated close friends), Elite Air may apply a reduction of the required advance days on a case-by-case basis, strictly subject to load and published operational limits. Details are explained to the Member at booking time.

6) Limitations & Fair Use

1. One seat per day maximum per membership; overlapping bookings are not permitted except as allowed by Clause 4(2).
2. No cash value; not combinable with other unlimited-use programs unless expressly stated.
3. Schedules, routes, and services may change; operational constraints and blackouts may apply.

7) Changes, Cancellations & Fees

1. Membership fees are non-refundable. Cancelling the membership stops future benefits.
2. Ticket changes/cancellations are governed by the fare conditions of the issued ticket.

8) Suspension & Termination

1. Elite Air may suspend or terminate for fraud, abuse, safety/security concerns, or material breach. Unused benefits are forfeited on termination.

9) Compliance & Liability

1. Travel is subject to Elite Air’s Conditions of Carriage, airport rules, and applicable laws.
2. To the fullest extent permitted by law, Elite Air is not liable for indirect or consequential losses. Nothing limits liability where prohibited by law.

10) Governing Law & Regulatory Framework

This Agreement is governed by the laws of the State of Kuwait, including the Kuwait Civil Aviation Law and regulations of the Directorate General of Civil Aviation (DGCA), the Kuwait Commercial Law, and principles analogous to time-sharing/membership schemes on disclosures and member rights. Venue and jurisdiction lie with the competent Kuwaiti courts.

11) Amendments

We may update these Terms for operational, legal, or safety reasons with prior notice. Continued use after the effective date constitutes acceptance.
